These Terms & Conditions ("Terms") govern your access to TripsMitra, including tour discovery, enquiries, confirmed bookings, and any support provided by our travel team (collectively, the "Services"). By using the Services you agree to comply with these Terms, our policies referenced herein, and applicable laws in India.
1) Key Definitions
- "Customer" or "you" means the person creating an account, submitting a booking, or paying for a tour.
- "Partners" refers to hotels, transport operators, guides, and other suppliers fulfilling the itinerary.
- "Booking" includes confirmed reservations, payment schedules, vouchers, and any add-ons approved by you.
2) Eligibility & Authority
- You must be at least 18 years old and legally capable of entering into binding contracts.
- If you book on behalf of a group, you confirm that you are authorised to share traveller information and make payments for the group.
- Ensure that all travellers meet supplier eligibility requirements (age, identification, health conditions, permits).
3) Accounts & Authentication
- Accounts can be created via email OTP, password, Google Identity Services, or Facebook Login.
- You are responsible for safeguarding login credentials and ensuring the accuracy of contact information.
- We may suspend or terminate access if we detect misuse, impersonation, or suspected fraud.
- Refer to our Data Deletion & Requests page to close an account.
4) Enquiries, Quotes & Confirmations
Package descriptions show inclusions (e.g., accommodation, meals, transfers, activities) and exclusions (e.g., personal expenses, optional sightseeing, permits). Quotes are valid for the stated period only and may change with supplier availability, seasonality, or fare revisions. A booking is confirmed when you receive a written confirmation and invoice from TripsMitra.
5) Pricing, Payments & Taxes
- All prices are quoted in INR unless otherwise stated and include applicable taxes when indicated.
- Payments are processed by secure gateways (e.g., Razorpay). Convenience fees charged by the gateway are disclosed before checkout.
- Partial payments or instalments must be completed within the communicated deadlines to retain reservations.
- Failure to pay on time may lead to cancellation, forfeiture of deposits, or price revisions due to supplier penalties.
6) Cancellations, Amendments & Refunds
- Specific cancellation policies are listed on the tour page and reiterated on your invoice. Supplier penalties prevail over general guidelines.
- Change requests (dates, headcount, room type) depend on availability and may carry administrative fees or fare differences.
- Refunds are processed to the original payment instrument. Gateway processing timelines typically range from 5-10 working days.
- No-shows or early departures are treated as per partner policies and may not be refundable.
7) Traveller Conduct & Safety
- Follow instructions issued by guides, chauffeurs, or on-ground partners; disruptive or unlawful behaviour may lead to termination without refund.
- Medical or activity-specific restrictions (e.g., treks, water sports) must be reviewed before participating. Secure necessary clearances or insurance.
- You are responsible for valid travel documents, permits, and compliance with local regulations during the tour.
8) Supplier Relationships
TripsMitra curates itineraries and coordinates with partners but does not operate every service directly. Supplier terms (railways, hotels, adventure operators) are binding once you accept a booking. We act as your single point of contact for coordination, but certain claims must be raised with the supplier as required by law.
9) Liability & Force Majeure
We strive to deliver the confirmed itinerary; however, we are not responsible for delays or losses arising from events beyond reasonable control (e.g., weather, strikes, natural disasters, transport disruptions, government directives). Our liability, to the extent permitted by law, is limited to the monies received by TripsMitra for the affected portion of the Services.
10) Privacy & Data Usage
Personal data is handled per our Privacy Policy. Social login providers share only minimal profile attributes needed to authenticate you. When you submit booking contact details or finish a social login we temporarily store the latest tour slug you interacted with so our team can continue the same conversation (e.g., phone callback about that itinerary). You may manage consents or request deletion via our Data Deletion & Requests page or by contacting support.
11) Intellectual Property & Permitted Use
Content, trademarks, logos, and custom itineraries on the Services belong to TripsMitra or licensors. You may not copy, distribute, or reuse any content outside personal, non-commercial purposes without written consent. Automated scraping or reverse engineering of our platform is prohibited.
12) Feedback, Reviews & Marketing
- By submitting reviews or testimonials you grant TripsMitra a non-exclusive right to display them on the Services.
- We may contact you for surveys or product updates; you can opt out at any time through preferences or by emailing support.
- Promotional offers are subject to eligibility criteria, validity periods, and inventory constraints.
13) Governing Law & Dispute Resolution
These Terms are governed by the laws of India. Courts located in Karnataka, India, have exclusive jurisdiction, subject to mandatory arbitration or mediation requirements that may be mutually agreed for a specific dispute.
